Bank discloses information to third party

Discovery

Irvings Law have successfully represented a client in a data breach compensation claim against a Bank but the parties have agreed to keep settlement details confidential. As such, for the purposes of this case report, the client will be referred to as ‘HG’ but the Bank will not be named.

The said Bank disclosed information relating to HG to a family member under the age of 18 without HG’s knowledge or consent. As such, this said personal information led to an estrangement between HG and the family member. HG’s wife on his behalf raised a complaint with the Bank who accepted they had shared personal information relating to HG and this should not have happened

Representation

As HG was not satisfied with the response, he instructed Irvings Law, specialist data protection firm, to assist in pursuing a claim. HG was offered a no win, no fee terms and after this, a Letter of Claim was submitted to the Bank seeking compensation following this breach of the Data Protection Act 2018, General Data Protection Regulations (GDPR), confidence and misuse of private information.

Resolution

In response, the Bank accepted the breach, specialist advice regards the value of the claim was obtained and negotiations then followed.  This resulted in HG settling his matter for just over £1,000.00 plus his legal costs.
