Cheshire Constabulary Pay Over £5,000.00 for Data Breach

Background

Mr Matthew McConville, Head of Irvings Law’s specialist Actions Against the Police and Data Breach Department, has successfully represented a client in a claim for compensation against Cheshire Constabulary. Due to confidentiality, the client will be referred to as Mr A.

Mr A received threats to his life and reported these to Cheshire Constabulary. Following doing this, Mr A did not hear back from Cheshire Constabulary until his estranged mother left a voicemail for him. After hearing such a voicemail, Mr A was forced to call his said estranged mother back and within that call, it transpired that Cheshire Constabulary had sent an update letter upon such a criminal investigation to Mr A’s old address despite knowing Mr A’s correct address and this update letter was opened by Mr A’s said estranged mother whom learned about what had happened to Mr A. Due to what happened, Mr A reported to Cheshire Constabulary that a data breach had occurred and following investigation, he received an apology, that a data breach had been committed and the service that he had received was not acceptable.

Representation

After this, Mr A approached specialist Actions Against the Police & Data Breach Solicitors, Irvings Law, for assistance. Mr McConville immediately acknowledged that what happened was completely wrong and without hesitation, offered to act for Mr A by way of “no win, no fee” presenting a claim to Cheshire Constabulary on the basis that Mr A’s human rights to privacy were breached as well as GDPR and his confidence following this misuse of private information.

Resolution

After presenting the claim, Cheshire Constabulary wished to settle Mr A’s claim and an agreement was reached without the need for Court proceedings to be commenced in a sum in excess of £5,000.00 including the payment of his legal costs.
