Background

Irvings recently acted for a couple who have two foster children. The birth parents were not allowed to know the new address of the children, to protect the safety of our clients and the children.

Representation

Despite this the NHS carelessly sent a letter to the birth parents that included the address of our clients. They were naturally concerned of the possible implications for themselves and the foster children and were both distressed as a result.

Medical reports were obtained for both, and Court proceedings issued. The NHS admitted the breach.

Resolution

Shortly after the claim was served, the NHS offered our clients £4000 each. The clients were happy to accept and achieve a quick and fair settlement without the additional stress of continuing with the Court proceedings.
