On the 28th February 2020, Styles and Wood Ltd went into liquidation and Ernst & Young LLP (EY) were appointment as administrators. Following on from this and on the 11th May 2020, EY published documents in error containing around 80 other employees of Styles and Wood Ltd. This error culminated in information such as names, addresses and money owed being disclosed. Those affected received a letter dated the 18th May 2020, advising that a data security incident had occurred for which EY apologised.
As EY have apologised and confirmed the data security incident has taken place, those affected can seek compensatory damages. In being the data controller, EY should have complied with their data protection obligations and ensured the safety and security of the personal information, thus preventing it from being unlawfully disclosed. EY have infringed the employees’ right to privacy of their personal data, by misusing the same. In line with the above, EY have also lost control of personal information, failed to process the said personal information in a manner than ensures the appropriate security of data in line with GDPR, breached the confidence of affected employees and as such are potentially liable in law to pay compensation.
