On the 23rd March 2020, Watford Community Housing Trust (‘WCHT’) sent an email to numerous residents in order to give an update in regards to the services that they provide during the Coronavirus situation. This email unfortunately disclosed the personal details of approximately 3,545 tenants to one another and included the following personal information:
- Home telephone number and mobile number
- Property ID
- Tenancy commencement
- Tenancy type
- Ethnic origin
- Date of Birth
- Local community
- Sexual orientation
The personal information of the affected tenants has been disclosed 3,544 other individuals. WCHT should have ensured, as data controller, the personal information/data of their tenants was not be compromised and disclosed to thousands of other tenants.
As such, WCHT have failed to protect their customers’ data and, as a result, they are potentially liable under the GDPR for the loss and control of their customers’ personal data. WCHT also failed to process the said data in a manner that ensures that the information was secure which has breached the confidence of their tenants as the have misused private information and infringed their tenants’ right to privacy.
